The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You retain all rights in, and are solely responsible for, the content you post or submit through the Service ("User Content"). By posting or submitting User Content through the Service, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Service and our business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR OTHERWISE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
IN NO EVENT WILL WE OR OUR AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
You agree to indemnify, defend, and hold harmless us and our affiliates, licensors, service providers, employees, agents, officers, and directors from any and all claims, liabilities, damages, costs, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.
We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Service after such modification will constitute your acceptance of the modified Terms. We also reserve the right to modify or discontinue the Service at any time without prior notice.
These Terms and your use of the Service will be governed by and construed in accordance with the laws of the State of [insert state], without giving effect to any choice of law or conflict of law provisions. Any legal action or proceeding arising out of or in connection with these Terms or the Service will be brought exclusively in the federal or state courts located in UAE.
Apple is not a sponsor nor is it involved in the activities of AlKanz campaign draws in any manner.
DRAW TERMS ("DRAW TERMS")
In addition to your agreement with the Terms, the following provisions apply to your participation in our captivating contest draws ("Draws") and your potential victory in attaining the enticing prizes ("Prizes").
We retain the right to revise these Draw Terms at any juncture without prior notice, and these revisions will become effective upon their display on the Platform.
You acknowledge and accept that it is your responsibility to periodically review these Draw Terms, ensuring your familiarity with any adjustments. Your continued use of the Platform and/or participation in Draws subsequent to any amendments shall indicate your consent to these changes.
The Draws will be conducted in compliance with the guidelines set forth by the relevant authorities in the UAE and are subject to their approval. These guidelines might be updated periodically.
Each respective Draw will be assigned a valid permit number, ensuring transparency and legitimacy.
For Draws hosted beyond the UAE's jurisdiction, AlKanz will adhere to the necessary regulatory requisites and permits of that jurisdiction, ensuring full compliance with the law.
Eligibility to participate in our Draws is exclusively granted to users holding a valid Membership on the Platform, satisfying all stipulated Terms.
Diverse types of Draws are available on the Platform, each associated with a product purchased via the AlKanz App. Upon adherence to these Terms, a purchase entitles you to a single complimentary ticket ("Ticket") for the corresponding Draw, enhancing your chances of winning.
Upon purchasing a product via the AlKanz App, you have the choice to:
For product collection, kindly visit our premises within fifteen (15) calendar days from the date of purchase. Ensure to present valid identification, as required at our sole discretion.
AlKanz reserves the right to allow an individual with a written Power of Attorney (POA) to collect the product on your behalf, subject to our evaluation on a case-by-case basis.
AlKanz holds the discretion to waive any unutilized credit in your Wallet after a reasonable duration, without prior notice.
Ticket numbers are auto-generated and may not follow a sequential order based on product purchase. Ticket generation occurs during checkout, upon completing the purchase process.
Tickets received through your Platform usage are non-refundable, non-transferable, and exclusively owned by you.
The duration of each Draw varies, and Prize distribution may occur on any day of the week for Draws that reach 'sold out' status at least 24 hours before the Draw day. Draws are conducted in the presence of a government representative, ensuring fairness and impartiality.
The Draw date is dependent on the availability of the government representative.
To participate in a Draw using your Ticket, ensure your entry prior to the sell-out of specified products or the closure of the Draw. In cases of timed Draws, entry is possible until the timer displayed on the campaign box expires. Draw periods may be extended at AlKanz's discretion, with prior notification to participants.
Draw winners are selected by the government representative and are notified on the Draw day. Winner names might be announced in local and regional media, as well as on the Platform and affiliated social media profiles, unless you opt out in writing prior to the Draw. Unless stated otherwise, each Draw will have one (1) winner.
On the Draw day, an email will be sent to your registered Platform email, outlining the subsequent steps for claiming your Prize. This process varies based on your location:
Once handed to the courier, the winner assumes responsibility for any transit-related issues.
By participating, winners consent to the use of content, including their name, media, and material generated during the Draw, for publication on various platforms. Withdrawal of consent might affect participation.
Prizes are awarded as displayed, with minor physical changes if any.
Prize registration/ownership transfer, if required, is completed in the winner's name as per the winning ticket. By participating, you confirm compliance with government and regulatory prerequisites.
If a winner is later deemed ineligible, we might reclaim the Prize at our discretion, in line with applicable laws.
We are not responsible for insurance, travel, medical expenses, or other personal costs incurred during Prize collection.
We hold no liability for claims, damages, or expenses arising from Prize usage or defects, including injury or loss.
Winners are accountable for applicable tax liabilities.
